1. About these terms

These terms are an agreement between you and CORE DF SP. Z O.O., ul. Kasprowicza 68/97, 01-949 Warszawa, Poland, registered under KRS 0000828493, NIP 1182206095 (“CoreDF”, “we”, “us”), the operator of Pinbeen. They apply to the Pinbeen apps for iPhone and Android, the web app and this website (together, “Pinbeen”).

By creating an account or using Pinbeen you accept these terms. If you do not agree, please do not use Pinbeen. Our privacy policy explains how we handle personal data.

2. The service

Pinbeen lets you mark the countries, regions, cities and places you have visited, lived in or want to visit, see statistics and badges, organise trips and photos, and share your map with friends. Pinbeen is free: there are no ads, no subscriptions and no paid features. Because the service is free, no payment obligations arise under these terms.

3. Who can use Pinbeen

You must be at least 16 years old, or the lower minimum age for using online services without parental consent in your country (never below 13). By using Pinbeen you confirm that you meet this requirement. You may only hold one personal account and must not create accounts by automated means.

4. Your account

You can sign up with an email address and password, or with Apple, Google or Facebook. Keep your login details confidential and tell us at [email protected] if you think someone else has accessed your account. You are responsible for activity under your account unless it results from a security failure on our side. Please keep your email address up to date so that we can reach you about your account.

Your username must not impersonate other people or organisations, infringe anyone’s rights or be offensive. We may ask you to change a username that breaks these rules.

5. Your content

“Your content” means everything you add to Pinbeen: marks, places, notes, ratings, trips, photos, comments, your profile and similar material. You keep all rights to your content.

So that we can run Pinbeen, you give us a non-exclusive, worldwide, royalty-free licence to host, store, copy, process, adapt (for example resize photos) and display your content, only as needed to provide Pinbeen to you and to the people you choose to share it with. The licence ends when you delete the content or your account, except for copies in backups until they rotate out and content that is needed to handle a report or legal claim.

You confirm that you have the rights needed to add your content, including photos, and that it does not infringe anyone else’s rights. Please respect other people’s privacy: do not post photos or personal information about others without their permission.

6. Acceptable use

When using Pinbeen you must not:

  • break the law or help anyone else do so;
  • post content that is illegal, hateful, harassing, threatening, sexually explicit, violent, deceptive or that exploits minors in any way;
  • infringe intellectual property, privacy or other rights of others;
  • impersonate anyone, or misrepresent your connection with anyone;
  • send spam, run scams or use Pinbeen for unsolicited advertising;
  • scrape, crawl or bulk-download Pinbeen data, or use our map tiles, images or data outside the Pinbeen apps;
  • probe, scan or test the vulnerability of our systems without permission (please report security issues to [email protected]), bypass security or rate limits, or interfere with the service;
  • upload malware, or reverse engineer the apps except where the law allows it.

7. Reports, moderation and complaints

You can report content or users directly in the app, or by email to [email protected]. Please explain why you believe the content is illegal or breaks these terms and where we can find it. You can also block other users at any time.

We review reports diligently and may remove content, restrict features or suspend or close accounts that break the law or these terms. Where we do so, we will tell the affected user the reasons, unless the law prevents us, and how to appeal. If you disagree with a decision, reply to our message or write to [email protected] within six months and a person will review it. You may also use an out-of-court dispute settlement body certified under the EU Digital Services Act, or go to court.

Our single point of contact for users and authorities under the Digital Services Act is [email protected]; we can communicate in English and Polish.

8. Maps, places and data sources

Pinbeen’s maps and place data come from third parties: map data © OpenStreetMap contributors (Open Database License), place names from GeoNames (CC BY 4.0) and boundaries from Natural Earth (public domain). Borders, names and the status of territories shown in Pinbeen do not express any opinion by us on the legal status of any country, territory or boundary. Country counts (195 or about 250) are a convention you can choose in settings, not an official list.

Map and place information may be incomplete or out of date. Do not rely on Pinbeen for navigation, safety or travel planning decisions.

9. Third-party services

Pinbeen works with services from other companies, such as Sign in with Apple, Google or Facebook and the App Store and Google Play. Your use of those services is governed by their own terms and policies, and we are not responsible for them.

10. Availability and changes to the service

We work hard to keep Pinbeen running, but we cannot promise it will always be available or free of errors. We may change, add or remove features, for example to improve the app, respond to legal requirements or keep it secure. If we decide to discontinue Pinbeen, we will give you at least 30 days’ notice where possible and a way to export your data.

11. No warranty

Pinbeen is provided free of charge, “as is” and “as available”. To the extent permitted by law, we give no warranties beyond those that cannot be excluded by law. Nothing in these terms affects your statutory rights as a consumer, including the rules on conformity of digital content and services where they apply.

12. Liability

We are fully liable for damage caused intentionally or through gross negligence, for injury to life, body or health, and wherever liability cannot be limited by law. Otherwise, and to the extent permitted by law, we are not liable for indirect or unforeseeable losses, loss of data that you could have prevented by exporting it, or losses caused by events outside our reasonable control. [Liability cap and consumer-law wording to be reviewed by counsel.]

13. Ending your use of Pinbeen

You can stop using Pinbeen at any time and delete your account in Settings → Account → Delete account or as described on the account deletion page.

We may suspend or close your account if you seriously or repeatedly break these terms or the law, if required by law, or to protect other users. Where reasonable, we will warn you first and give you the chance to export your data. These terms continue to apply to anything that by its nature should survive termination.

14. Changes to these terms

We may update these terms, for example when we add features or the law changes. We will tell you about material changes in the app or by email at least 30 days before they take effect, unless a shorter period is required for legal or security reasons. If you do not agree, you can delete your account before the changes apply; continuing to use Pinbeen afterwards means you accept the new terms.

15. Additional terms for the Apple App Store

If you downloaded Pinbeen from the Apple App Store, the following also applies:

  • These terms are between you and CoreDF, not Apple. CoreDF, not Apple, is solely responsible for Pinbeen and its content.
  • Apple has no obligation to provide maintenance or support for Pinbeen.
  • To the extent permitted by law, Apple has no warranty obligation with respect to Pinbeen. Pinbeen is free, so there is no purchase price to refund.
  • CoreDF, not Apple, is responsible for addressing any claims relating to Pinbeen, including product liability claims, claims that Pinbeen fails to meet legal or regulatory requirements, consumer protection or privacy claims, and claims that Pinbeen infringes a third party’s intellectual property rights.
  • You confirm that you are not located in a country subject to a U.S. Government embargo or designated as “terrorist supporting”, and are not listed on any U.S. Government list of prohibited or restricted parties.
  • Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

16. Governing law and disputes

These terms are governed by the laws of Poland. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring proceedings in the courts of that country. [Jurisdiction clause for non-consumers to be confirmed.]
